Self-examination and mutual evaluation: the last mile of comprehensive agricultural administrative law enforcement reform

Rule of Law Daily reporter Hou Jianbin

Looking back on the past 2021, new breakthroughs were made in the reform of agricultural comprehensive administrative law enforcement.

This year, the self-examination and cross-evaluation of agricultural comprehensive administrative law enforcement reform covering 29 provinces (autonomous regions and municipalities directly under the Central Government) were in full swing. Among them, 10 working groups of cross-provincial cross-evaluation visited 52 cities, counties and districts, and found 137 problems and 85 highlights.

This is the "last mile" for the Law and Regulation Department of the Ministry of Agriculture and Rural Affairs to focus on the reform task. Aiming at the difficult and painful problems of reform, it is a powerful measure to innovate the working ideas and methods, accelerate the basic completion of the reform task, significantly improve the ability and quality of the law enforcement team, and effectively play the role of law enforcement escort.

The relevant person in charge of the Law and Regulation Department of the Ministry of Agriculture and Rural Affairs said that we must continue to deepen the reform with greater determination and courage, organically combine vigorous and resolute actions with long-term achievements, constantly improve the law enforcement system, build a strong law enforcement team, and enhance law enforcement capabilities, so as to provide a stronger guarantee of the rule of law for comprehensively promoting rural revitalization and agricultural and rural modernization.

  Carefully design the evaluation scheme

When carrying out self-examination and mutual evaluation, the Law Department of the Ministry of Agriculture and Rural Affairs adheres to the problem-oriented and goal-oriented, carefully designs the evaluation plan, refines the evaluation content, quantifies the evaluation criteria, materializes the work requirements, and pragmatically promotes the implementation of various reform measures.

According to reports, the Law and Regulation Department of the Ministry of Agriculture and Rural Affairs will promote the establishment of agricultural comprehensive administrative law enforcement agencies, the issuance of "three decisions", the transfer of personnel, and the "four in place" of law enforcement guarantee as the overall goal of self-examination and cross-evaluation work, and on this basis, deeply analyze the main factors affecting the reform of agricultural comprehensive administrative law enforcement and the evaluation of law enforcement work, and refine and refine 43 evaluation indicators in six aspects: institutional setup, team management, system construction, condition guarantee, law enforcement work and party building. Local agricultural and rural departments are required to take a "microscope" and directly attack the problem with the evaluation results of yes or no, and conduct a comprehensive physical examination of the reform and law enforcement of agricultural comprehensive administrative law enforcement in various places.

In the way of organization, the methods of self-examination and self-correction, intra-provincial mutual evaluation and cross-provincial mutual evaluation are adopted to fully mobilize the enthusiasm of agricultural and rural authorities at all levels.

In the way of evaluation, we comprehensively use the methods of listening to reports, consulting materials, on-the-spot inspection and individual talks to comprehensively understand the implementation of reform tasks and the completion of key law enforcement work, which not only makes no secret of aiming at real problems and making suggestions, but also actively finds out the highlights and typical experiences emerging in grassroots practice.

In the arrangement of working groups, taking into account the reform effect, work quality, location layout and other factors in various provinces, we set up cross-provincial mutual evaluation groups in the way of "combining East and West, matching strength and weakness", and scientifically designed the evaluation area of each group, so that each working group can look at itself while finding problems in other provinces, and pass on classics and send treasures while discovering highlights.

In order to fully transmit the pressure and give full play to its main role, self-examination and mutual evaluation are combined to compact the responsibility from bottom to top and from point to surface.

On the basis of full self-examination and self-correction in the province, the Law Department of the Ministry of Agriculture and Rural Affairs carried out cross-provincial mutual evaluation from August to September in 2021, further searching for shortcomings, excavating highlights and implementing measures, and taking the "last mile" of comprehensive agricultural administrative law enforcement reform measures.

Aim at the shortcomings of the problem

The later the reform, the rest are hard bones.

Local agricultural and rural departments regard this self-examination and mutual evaluation as a good opportunity to find and solve problems, and actively take effective measures to promote the reform to go deeper and deeper.

Hubei Provincial Department of Agriculture and Rural Affairs actively communicated and coordinated with the provincial party committee, striving for the establishment of a provincial agricultural comprehensive administrative law enforcement supervision bureau, which solved the problem that the provincial comprehensive law enforcement agency was delayed.

The Agricultural and Rural Bureau of Zezhou County, Shanxi Province actively strives for the attention of the Party Committee and government and the support of the establishment department, and coordinates the implementation of the establishment of 36 agricultural law enforcement personnel, which is more than three times higher than before the reform.

The Agriculture and Animal Husbandry Department of Inner Mongolia Autonomous Region, according to the method of "removing one and building one", set up the law enforcement and supervision department which was co-located with the Law and Regulation Department separately, effectively solving the problem of "athletes" and "referees" being separated.

At the same time, the agricultural and rural departments in various places have carried out "self-revolution" with the determination of moving the truth and hitting the hard. In view of the problem that personnel transfer is not in place, Liaoning Provincial Department of Agriculture and Rural Affairs has strengthened supervision and guidance, and made great efforts to promote the transfer of city and county law enforcement personnel. By the end of September 2021, the overall rate of law enforcement personnel in the province was 90.3%.

In view of the lack of ability of law enforcement personnel at the grass-roots level, the Agriculture and Rural Affairs Department of Sichuan Province held a comprehensive agricultural law enforcement training meeting in the whole province, and invited experts from public security, justice, courts, procuratorates and other departments to give lectures by means of "on-site training+online live broadcast", with a total training of more than 8,000 people.

In order to solve the problem of insufficient law enforcement guarantee, Jiangxi Provincial Department of Agriculture and Rural Affairs arranged 9.65 million yuan for provincial-level law enforcement capacity improvement projects, which were used for agricultural input law enforcement sampling inspection, law enforcement case handling subsidies and fishery law enforcement subsidies.

In view of the problem that some law enforcement agencies have not handled cases for a long time, the Agriculture and Rural Affairs Department of Qinghai Province specially organized personnel to sink to Yushu, Guoluo and other areas with weak law enforcement work to supervise the war, and nine counties achieved "zero breakthrough" in law enforcement and handling cases.

The relevant person in charge of the Regulation Department of the Ministry of Agriculture and Rural Affairs pointed out that in view of the places where the reform is not in place and the problems are more prominent, various localities are fighting on wall charts, reversing the construction period, and adopting targeted methods such as interviews, notifications and letters to urge them to speed up the reform progress.

In-depth mutual evaluation and mutual learning

Cross-provincial mutual evaluation involves a wide range, and the situation is diverse and the work basis is different. In order to ensure the realization of the expected goal, the Law Department of the Ministry of Agriculture and Rural Affairs selected 30 provincial law enforcement frontline backbones with solid theory and rich experience from all over the country to form 10 working groups. The relevant person in charge of the Law and Regulation Department of the Ministry of Agriculture and Rural Affairs pointed out that these experts, who know both policy and practice, give fair and just judgments on the reform and law enforcement of comprehensive agricultural administrative law enforcement in various places, and at the same time help local areas find true models, dig out real problems and urge real rectification from the perspective of experts in the industry, which has been widely praised by all localities.

It is reported that after the reform of agricultural comprehensive administrative law enforcement entered the third year, there are still some deep-seated contradictions and problems that need to be solved urgently. Wherever the working group goes, it should seriously consult the specific problems in the reform in light of local conditions and put forward countermeasures and suggestions. While discovering the problems, the working groups also pay attention to excavating the good experiences and practices that have emerged in the reform practice in various places and have replicability and popularization significance.

The person in charge stressed that cross-provincial cross-evaluation is not only a centralized inspection of the reform results, but also a rare opportunity for exchange, learning and mutual learning. Some provinces have reached communication and coordination and law enforcement cooperation mechanisms such as twinning, flexible assistance and regional law enforcement integration through cross-evaluation.

For example, Zhejiang Province and Xinjiang Uygur Autonomous Region set up a flexible assistance mechanism, organized a delegation of experts on comprehensive agricultural administrative law enforcement at the provincial, city and county levels to go to Aksu to carry out flexible agricultural law enforcement assistance to Xinjiang, taught the Xinjiang Uygur Autonomous Region 2021 regional comprehensive agricultural administrative law enforcement capacity improvement class, and gave on-the-spot guidance on issues such as case file making, clue handling, and investigation and evidence collection skills.

In order to make full use of the results of self-examination and cross-evaluation, the Department of Laws and Regulations of the Ministry of Agriculture and Rural Affairs gave feedback to the provinces (autonomous regions and municipalities directly under the Central Government) on the evaluation and problems found one by one, and urged local agricultural and rural authorities to take the initiative to accept accounts and take practical and effective measures to immediately rectify them.

He who does not seek easy will succeed, and he who does not seek refuge will enter. At present, the task of reforming agricultural comprehensive administrative law enforcement agencies has been basically completed, and the task of improving team capacity is still arduous. The person in charge said that we must continue to deepen reform with greater determination and courage, constantly improve the law enforcement system, build a strong law enforcement team, and enhance law enforcement capabilities, so as to provide more powerful legal protection for comprehensively promoting rural revitalization and agricultural and rural modernization.
